Burg Simpson Represents 2 Families After THC Gelato Exposure – Burg Simpson

Burg Simpson is representing two families whose children were rushed to the hospital due to THC exposure at Isabella’s Kitchen, a high-end restaurant at Grayhawk Golf Club in north Scottsdale. The incident occurred on December 30, 2021, when the children were served vanilla gelato laced with THC, the active ingredient in marijuana.
After doctors discovered that marijuana exposure had caused the children’s illness, both families realized the common factor was the vanilla gelato that was served as a complimentary scoop with every kid’s meal.
Phoenix personal injury attorney Michael Burg is leading the case against the former owners of the restaurant and the gelato manufacturer, Heartbreak Creamery. The lawsuit alleges negligence on the part of these companies for serving harmful drugs to children.
The situation took a further distressing turn when the Bidner family was reported to the Arizona Department of Child Safety (DCS) due to the large amount of THC found in their son’s system. The families argue that they suffered serious damages and that the incident could have led to the removal of their children from their homes.
The Scottsdale Police Department investigated the case and confiscated three tubs of vanilla-bean gelato as evidence. Lab results from the Arizona Department of Agriculture found the gelato tested positive for THC. During their investigation, police discovered that three restaurant employees, one of whom was 13 weeks pregnant, had also become ill after eating vanilla gelato the same evening, reporting that they were, “too high to drive.”
The police have not filed charges, stating that the employees unknowingly served the gelato and had no intent to harm anyone. The gelato owner received a criminal citation from the Department of Agriculture for operating without a proper dairy license.
The new owners of Grayhawk Golf Club, Arcis Golf, expressed regret over the incident that occurred before their purchase in June 2023. They stated that the former owners terminated the vendor immediately and cooperated with the investigation. Since the acquisition, Arcis Golf claims to have implemented additional improvements in food safety.
The families, however, demand accountability and hope their legal action will prevent similar incidents in the future.
Michael Burg spoke with Arizona news station ABC15 about the case, saying, “They haven’t been held accountable yet. They have to be held accountable so this never happens to anybody else.”
